Recital 40

This Regulation should build on the principles in Regulation (EU) No 604/2013 of the European Parliament and of the Council (11) while addressing the challenges identified and developing the principle of solidarity and fair sharing of responsibility as part of the common framework, in line with Article 80 TFEUTreaty on the Functioning of the European Union. To that end, a new mandatory solidarity mechanism should enable a strengthened preparedness of Member States to manage migration, to address situations where Member States are faced with migratory pressure and to facilitate regular solidarity support among Member States. The effective implementation of such a solidarity mechanism is, together with an effective system for determining the Member State responsible, a key prerequisite to the functioning of the Common European Asylum System as a whole.
