Procedures Regulation:
Recital 23

The best interests of the child should be a primary consideration of Member States when applying this Regulation, in accordance with Article 24 of the Charter of Fundamental Rights of the European Union (the ‘Charter’) and the 1989 United Nations Convention on the Rights of the Child. In assessing the best interests of the child, Member States should in particular take due account of the minor’s well-being and social development, including his or her background. In view of Article 12 of the United Nations Convention on the Rights of the Child concerning the child’s right to be heard, the determining authority should provide a minor with the possibility of a personal interview, unless this is not in the best interests of the child. The determining authority should organise a personal interview for a minor taking into account in particular his or her age and maturity.
