Crisis and Force Majeure Regulation:
Recital 45

In situations of crisis, characterised by mass arrivals of third-country nationals and stateless persons, or of force majeure, it could be necessary to allow a Member State not to apply the border procedure in respect of persons who come from third countries where the Union-wide average recognition rate is below 20 %. In order to apply such a derogation, the Council implementing decision should assess whether the measures contained in the contingency plan of the Member State concerned, referred to in Article 32 of Directive (EU) 2024/1346Reception Directive are sufficient to address the situation. In any event, Member States are obliged to apply the border procedure in the situations referred to in Article 42(1), points (c) and (f), of Regulation (EU) 2024/1348Procedures Regulation.
